Welcome to Nudge. These Terms of Use (“Terms”) govern your access to and use of the Nudge mobile application (the “App”), provided by [YOUR COMPANY NAME] (“we,” “us,” or “our”). By downloading, accessing, or using Nudge, you agree to be bound by these Terms. If you do not agree, please do not use the App.


1. Description of the App

Nudge is a digital wellbeing app designed to help you pause before opening selected distracting apps on your device. Nudge uses Apple’s Screen Time API (FamilyControls, ManagedSettings, and DeviceActivity frameworks) to detect when you open an app you’ve chosen to protect, and presents a brief intervention screen — such as a countdown, intention check, breathing exercise, or reflection prompt — before allowing you to continue.

Nudge is a wellbeing and productivity tool. It is not a medical device and is not intended to diagnose, treat, cure, or prevent any medical or mental health condition, including ADHD. See Section 9 below.


2. Eligibility

You must be at least 13 years old (or the minimum age required in your country to use mobile applications without parental consent) to use Nudge. By using the App, you represent that you meet this requirement. If you are using the App on behalf of a minor, you are responsible for ensuring this use complies with applicable law.


3. Account Registration

Some features of Nudge may require you to create an account. You agree to:

  • Provide accurate and complete information when creating your account
  • Keep your login credentials confidential
  • Notify us promptly of any unauthorized use of your account
  • Be responsible for all activity that occurs under your account

We reserve the right to suspend or terminate accounts that violate these Terms.


4. Screen Time Permissions

Nudge’s core functionality requires you to grant Screen Time / Family Controls authorization through Apple’s system permission dialog. By granting this permission, you authorize Nudge to:

  • Detect when apps you’ve selected are opened
  • Display a shield/intervention screen over those apps
  • Temporarily restrict access to those apps until you complete the relevant intervention

You may revoke this permission at any time through your device’s Settings app. Doing so will disable Nudge’s core intervention features. Nudge is not responsible for any consequences resulting from your choice to revoke or not grant this permission, including continued use of apps you intended to limit.

Important technical limitation: Apple’s Screen Time API does not guarantee that Nudge can directly reopen itself or the protected app after an intervention in all circumstances. Nudge uses local notifications and other supported mechanisms to bridge this gap. Occasional delays, missed shields, or unexpected behavior may occur due to limitations of Apple’s frameworks, iOS updates, or device-specific issues, and are outside of our control.


5. Subscriptions

5.1 Subscription Plans

Nudge offers the following auto-renewing subscription plans for access to “Nudge Pro” features:

  • Monthly Plan: $9.99 USD, billed every month
  • Annual Plan: $59.99 USD, billed every year

Prices may vary by region due to currency conversion, local taxes, and Apple’s regional pricing tiers, and are subject to change with advance notice as required by applicable law and App Store policy.

5.2 Free Trial

We may offer a free trial period for new subscribers. If you do not cancel before the trial period ends, you will automatically be charged for the subscription plan you selected. The length of any free trial will be clearly disclosed before you start it.

5.3 Billing and Renewal

  • Subscriptions are billed and managed through your Apple ID account via the App Store.
  • Your subscription automatically renews unless you cancel at least 24 hours before the end of the current billing period.
  • Your Apple ID account will be charged for renewal within 24 hours prior to the end of the current period, at the price you originally agreed to (subject to any price changes disclosed in advance).

5.4 Managing or Cancelling Your Subscription

You can manage or cancel your subscription at any time through your device’s Settings app (Settings → [Your Name] → Subscriptions), or through the App Store. Cancelling stops future billing but does not provide a refund for the current billing period unless required by applicable law.

5.5 Refunds

All purchases are processed by Apple. Refund requests must be submitted directly to Apple through your purchase history, as we do not have the ability to issue refunds on Apple’s behalf. Refunds are subject to Apple’s policies.

5.6 Free Tier

Nudge offers certain features at no cost, with limitations (such as a maximum number of protected apps or limited intervention types). We reserve the right to modify what is included in the free tier at any time.


6. Acceptable Use

You agree not to:

  • Use the App for any unlawful purpose or in violation of any applicable law or regulation
  • Attempt to reverse-engineer, decompile, or disassemble the App, except as permitted by applicable law
  • Interfere with or disrupt the operation of the App or its servers
  • Attempt to circumvent any subscription, payment, or access-control mechanism within the App
  • Use the App to harass, abuse, or harm another person
  • Use automated systems or bots to access the App in a manner that sends more requests than a human could reasonably produce

7. Intellectual Property

The App, including its design, graphics, text, logos, and underlying code, is owned by us or our licensors and is protected by copyright, trademark, and other intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for your personal, non-commercial use, subject to these Terms. You may not copy, modify, distribute, sell, or lease any part of the App without our prior written consent.


8. User Content

If Nudge allows you to submit content (such as a display name or feedback), you retain ownership of that content, but you grant us a non-exclusive, worldwide, royalty-free license to use, store, and display that content as necessary to operate and improve the App. You are solely responsible for any content you submit and agree it will not violate any law or third-party right.


9. No Medical Advice Disclaimer

Nudge is designed as a general wellness and productivity tool. While Nudge’s intervention design is informed by behavioral research, including research on impulsivity and ADHD-related social media use, Nudge is not a medical device, diagnostic tool, or substitute for professional medical, psychological, or psychiatric advice, diagnosis, or treatment.

If you have ADHD or any other medical or mental health condition, please consult a qualified healthcare provider regarding your treatment. Never disregard professional medical advice or delay seeking it because of something you encountered while using Nudge. If you are experiencing a medical or mental health emergency, contact your local emergency services immediately.


10. Disclaimer of Warranties

THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT ANY INTERVENTION, SHIELD, OR NOTIFICATION WILL FUNCTION WITHOUT FAIL DUE TO LIMITATIONS OF THIRD-PARTY PLATFORMS, INCLUDING APPLE’S OPERATING SYSTEM AND FRAMEWORKS.


11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, [YOUR COMPANY NAME] SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF OR INABILITY TO USE THE APP, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE APP SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

Some jurisdictions do not allow certain limitations of liability, so some of the above limitations may not apply to you.


12. Termination

We may suspend or terminate your access to the App at any time, with or without notice, for conduct that we believe violates these Terms or is otherwise harmful to other users, us, or third parties. You may stop using the App and delete your account at any time. Provisions of these Terms that by their nature should survive termination will survive, including ownership provisions, warranty disclaimers, and limitations of liability.


13. Changes to the App and These Terms

We may modify, suspend, or discontinue the App, or any part of it, at any time without liability. We may also update these Terms from time to time. If we make material changes, we will provide notice through the App or other reasonable means. Your continued use of the App after changes take effect constitutes acceptance of the revised Terms.


14. Third-Party Services

The App relies on third-party platforms and services, including Apple’s iOS operating system, Screen Time/Family Controls frameworks, the App Store, and Google Firebase. Your use of the App is also subject to Apple’s standard End User License Agreement and any applicable terms of these third parties. We are not responsible for the availability, accuracy, or performance of third-party services.


15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of [YOUR JURISDICTION], without regard to its conflict of law principles. Any disputes arising from these Terms or your use of the App shall be subject to the exclusive jurisdiction of the courts located in [YOUR JURISDICTION], unless otherwise required by applicable consumer protection law in your country of residence.
